The following terms and conditions will apply between you and Saga Garden Centre when you buy an item from Saga Garden Centre. The terms do not affect your statutory rights.
Your contract for purchases made through Saga Garden Centre is with Jersey Choice Ltd and you undertake that all goods ordered by you are for your own private and domestic use only and are not for resale.

We make every effort to ensure that all our plants are of the highest quality and are fully inspected prior to dispatch. If however you feel that the plant received is not in reasonable condition then please contact us IMMEDIATELY. Please bear in mind the following:
Not Planting Until the Weekend?
Should you receive your plants but have no plans to transplant (as required) within 24 hours then please bear in mind they are 'Live'. Please ensure you open the packaging, water the plant and expose it to daylight until you are ready to plant. See care instructions for individual details.
It's important that you take an image of the plant as soon as possible so there is no doubt as to its condition when it was received. We may request the plant is returned to us for further investigation so we can establish the cause of the problem.
Saga Garden Centre accepts Mastercard, Visa and Solo Credit cards and Switch Debit cards.
The value of your order will be debited from your debit or credit card at the time of ordering.
We will take all reasonable care to keep information given to us by our customers secure but we cannot be held liable for any loss that you may incur if a third party obtains unauthorised access to any data, including credit card and account details you provide when accessing or ordering from our website, unless this is solely due to negligence caused by Saga Garden Centre.
All credit and debit card payments are subject to validation checks & authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery of your order.
The price shown for our products on the website when placing your order is the price that you, the customer, will pay and includes VAT. We reserve the right to change prices at any time without prior notice. All prices are shown in UK pounds sterling. If it subsequently transpires that VAT is not due on your transaction, we reserve the right to retain the VAT.
The delivery period stated within which you will receive your order is approximate. Goods will be sent to the address given by you on your order.
Our items are delivered throughout the UK by courier. Unfortunately, we are unable to deliver to PO Box numbers or to Armed Forces stationed overseas. Should we be given incorrect or inadequate address details we cannot accept any liability for late or failed delivery of the order.
Here at Saga Garden Centre we are committed to providing you with a superior customer service and are confident that the utmost care and attention to detail has been taken in the processing, packing and delivery of your order to ensure that you receive it in perfect condition. However should you not be entirely satisfied or should the goods you receive be damaged or defective please notify us within 14 days of receipt and we will provide you with a replacement or refund.
Your statutory rights are not affected.

Late deliveries and other problems
We do of course make every effort to ensure that your order will arrive within the delivery times indicated on the website. Unfortunately, on rare occasions this may not always be possible. Should your order be delayed or fail to arrive when expected, please contact us immediately and we will do our best to resolve any problems. (Please note that our liability does not extend to providing compensation for late or failed deliveries.) We make every reasonable effort to ensure that your order meets - and hopefully exceeds - your expectations. Of course, in rare cases things can sometimes go wrong and we will always do everything we can to rectify any problems in a quick and satisfactory manner. However please note that we cannot be held responsible for any resulting additional expense you may incur unless with our prior agreement.
We reserve the right to modify these terms and conditions without notice and so you should view them each time you visit our website. Your use of this website signifies your agreement to these terms and conditions. They constitute a contract between you and us governing your use of this website. If you are a consumer your statutory rights are not affected by this agreement.
Delivery Times & Rates
We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors and all goods and products are subject to availability.
Saga Garden Centre shall be under no liability for any delay or failure to deliver the products within estimated timescales. If you are purchasing to replace some of your existing goods, we also recommend that you do not dispose of your existing goods until your new goods have arrived and been checked for damage.
Where delivery is attempted and there is no response, our carrier will make a number of attempts to re-deliver the goods. If they are unable to deliver the goods to you, they will be returned to us, with the additional costs incurred being charged to you. Should you ask for the goods to be re-delivered you will be required to pay an additional delivery charge.
All products are subject to changes in packaging to ensure the best and safest delivery, if we think that your goods will be better suited in a differently branded box / container we will use this as an alternative packaging solution.

If you have supplied us with your email address, we will notify you by email as soon as possible to acknowledge your order. Please note that this e-mail is not an order confirmation or order acceptance from Saga Garden Centre. Our acceptance of your order will take place upon dispatch of the product(s) ordered.
Changing or Cancelling Orders
We request that you contact us by emailing email@example.com. This is the only way we can guarantee an order will be cancelled before it is shipped. If your order has not yet been dispatched then this will be possible FOC, however if your order has been despatched or you have received the order you will be liable to pay a charge based upon the direct cost to recover and/or redeliver goods. We request that changed / cancelled items are returned in their original packaging.
Delivery discrepancies: Any discrepancies must be reported as soon as is reasonable after delivery, preferably within 24hrs. On arrival, if the packaging appears damaged it is advisable that this is marked on the delivery note before you sign.
If you haven't submitted an order, you may clear the items in your shopping basket at any time by clicking the 'Remove' button next to the product you do not wish to purchase in your shopping basket.
If you have placed an order but then wish to change or cancel it, please contact us as soon as you can. We will try our best to make any changes but we cannot guarantee that we will be able to do so as the order may already have been processed. We operate a 30 day Replacement or Refunds policy.
Once we've heard from you that you wish to cancel an order, any sum debited to us from your credit or debit card will be re-credited to that credit or debit account within 30 days of your order.
Saga Garden Centre will be happy to exchange products that are damaged or incorrectly shipped through any circumstance that is in our error within 30 days from the date of despatch. For more information, please refer Contact Customer Services.
How Do I Return An Item I Have Received But No Longer Require?
If you have ordered and received an item that you no longer require, you can send it back to us.
To do so please contact our Customer Service team by email: firstname.lastname@example.org. We must be informed within 14 days of your receipt of the order. We will then email you with a returns form to be printed, completed and attached to the item to be returned. You then have 14 Calendar days to ensure that the item is received by our warehouse, after this time period we will not be able to issue you with a refund.
Once we have received the item back within the timescale advised, we will inspect it to ensure that the item is not damaged and when we are happy that the product is re-sellable we will issue a full refund to the value of the product.
Please note that all products returned must be returned in their original packaging. We do not arrange collections for unwanted items; however we do issue full product refunds for items returned to us by customers based upon the guidelines listed above.
Can I Return Goods That Have Been Assembled?
Regrettably, if goods have been assembled then the item cannot be returned to us as it will not be classed as in a resalable condition. All items should be checked for faults before the goods are assembled, if the fault is only noticeable during or after assembly then under these circumstances the item would be classed as returnable.
If I Require A Replacement Of My Damaged Or Faulty Product, What Should I Do?
If the goods are returned to us following refused delivery and upon inspection they are not deemed to be damaged then the product cost will be refunded.
If you take delivery of a product that comes to you complete but due to manufacturing is deemed faulty then you should advise us within 24 hours of receipt of the goods via email to email@example.com with photographs of any fault (unless this is an electrical appliance which will be PAT tested upon return). When the goods are received back and inspected we will liaise with the manufacturer to arrange a refund or replacement.
Who Pays For The Return Costs?
This depends on the reason for the return. If a product is faulty or damaged we will cover the costs of the return and the cost of delivering a replacement. If the product is unwanted or exchanged, then we will not cover the cost of the return and it is up to you to return the product to us in re-saleable condition. Once we have received the unwanted item back, we will inspect the product to ensure it is not damaged and then issue a refund for the value of the product.

How Long Does The Refund Take To Go Back Into My Account?

What Happens If I Refuse Delivery?
If you refuse delivery of an order you will be subject to a return admin fee deemed reasonable in accordance with the order. These fees will be deducted from the refund amount which shall be issued once the goods are received back in our warehouse.
On delivery: Should an item be missing please notify us as soon as possible, and within 24hrs of delivery - we will not be held responsible for missing items if you have agreed for a delivery to be left somewhere without a signature.
On assembly: Should a part appear missing from an item please report the item that is missing the part along with a description of part you believe to be missing. In both the above instances replacement goods will be despatched as soon as possible.
Damaged goods must be reported to us as soon as is deemed reasonable, within 24 hours of delivery. It is the responsibility of the recipient to check for any damage sustained to the goods during transit. You must take all reasonable steps to ensure that there is no transit damage, and if there is you must indicate this on the courier form/delivery note and inform Saga Garden Centre immediately.
You must report the fault to us with a full description of the alleged damage. If the fault is deemed a manufacturers fault or to have occurred during the manufacturing process, then we will replace the faulty item or part FOC.
If the damage has occurred during the transit we will replace the item or part FOC. If items are lost in transit we will replace this FOC. In all instances we will request photographic evidence to be supplied of the damaged or faulty goods.
When acceptance of an order takes place, the consumer loses the right to reject the goods, within 14 days, unless the item has been altered or use of the item continues after a complaint is registered with us.
All our stock is of a high quality and with correct use you should not experience any problems other than general wear and tear. A consumer has no rights in respect of defects that are bought to his/her attention

Where an item(s) is/are not wanted or has been incorrectly ordered the customer is responsible for any costs incurred to return the item(s). The item must be returned to us together with a completed returns form. All goods must be returned with their original packaging in the same condition they were delivered and in a re-saleable condition.

On some occasions we may securely pass information to carefully selected third parties to enable them to mail you with details of products which may be of interest to you. We never disclose your payment details to these third parties.

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
We reserve the right to offer alternative products that are similar as long as they are of the same or greater value.
How Will We Use Your Details?
Our offers: Once you have purchased with us, we would like to send you product updates, our latest information and special offers. You can always e-mail us with your details and mailing preferences.
We may also use your information to manage your purchases such as sending a confirmatory email, and confirmation of your card payments for goods you buy from us and also to deliver the goods to you, or we might give your details to our carrier if they deliver on our behalf.
We do not hold any credit card details, when you provide these to us we use the details to take the authorised amount and then securely destroy all records of the details.

Our online ordering system uses a cookie to record a unique reference on your computer so that we can keep track of your order and retain the contents in your shopping basket.

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question. We have taken every measure to provide accurate product images for each product for sale on the site. However, due to a number of different factors such as Internet browsers, monitor colour contrasts etc, we cannot be held responsible or liable for any differences in colour between the image and the actual product.

We take payment from your card at the time we receive your order, once we have checked your card details.
Fraud checks are conducted on all our orders. This involves checks on details provided during the order process including the address details. This may involve your details being passed to a 3rd party fraud checking company.
On occasion, we may ask for additional information in order to process your order. We will conduct this process as quickly as possible however dispatch of goods may be delayed.
Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
The price you pay is the price displayed on this website at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Title to any products you order on this website shall pass to you on the delivery of the products, provided that we have processed and received payment in full for the products.
